PEDAL FOR PRIDE 2027
RIDER ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND COVENANT NOT TO SUE
Participation and scope
I voluntarily choose to participate as a Rider in Pedal for Pride 2027, a five-day supported cycling ride scheduled for August 15 through August 19, 2027, traveling approximately 400 miles from Traverse City to Ferndale, Michigan.
For purposes of this agreement, the "Event" includes official training rides, meetings, transportation provided as part of the ride, cycling routes, rest stops, campsites, meals, equipment assistance, support-vehicle activities, and other activities organized as part of Pedal for Pride 2027. I understand that routes, schedules, lodging, transportation, and support arrangements may change because of weather, road conditions, safety concerns, availability, or other circumstances.
Released Parties
The "Released Parties" are Pedal for Pride; Ryanne Riegling, individually and in her capacity as the Event organizer; the Event's ride leaders, roadies, volunteers, support-vehicle owners and drivers; any sponsor or Event partner specifically identified in the registration materials as a Released Party, but only with respect to its involvement in the Event; and their respective agents, representatives, insurers, successors, and assigns where those roles or relationships legally exist.
Affirmations LGBTQ+ Community Center is the intended beneficiary of the Event. It is not an organizer or Released Party solely because it receives Event proceeds.
This agreement does not release claims against an unrelated motorist or other unaffiliated third party merely because an incident occurs during the Event.
Assumption of risk
I understand that long-distance cycling on public roads, trails, and shared-use paths involves inherent and other serious risks. These risks may result in bodily injury, permanent disability, death, property damage, medical expenses, economic loss, or noneconomic loss.
I knowingly and voluntarily assume the known and unknown, anticipated and unanticipated risks of participating in the Event, including:
- Motor vehicles and the conduct of negligent, reckless, distracted, impaired, uninsured, or underinsured drivers;
- Intersections, traffic signals, roads without shoulders, construction, potholes, pavement defects, gravel, debris, railroad crossings, trails, pedestrians, and animals;
- Group riding, pace lines, collisions, falls, navigation mistakes, separation from the group, and route changes;
- Heat, cold, rain, wind, lightning, poor visibility, exhaustion, dehydration, illness, and other medical events;
- Bicycle, helmet, equipment, or mechanical failure;
- Delayed or unavailable medical, mechanical, or emergency assistance;
- Support vehicles, trailers, transportation, and bicycle loading or unloading;
- Campsites, food, shared facilities, overnight activities, and the conduct of participants, volunteers, and third parties; and
- Other risks arising from or related to my participation.
I understand that route planning, ride leaders, roadies, rest stops, support vehicles, and other Event support cannot eliminate every hazard, prevent every error, guarantee my safety, or guarantee immediate assistance.
Health and safety responsibilities
I am responsible for determining whether I am physically and medically prepared to participate. I will disclose information reasonably necessary for emergency planning, carry any medications I may need, and maintain health insurance that I consider appropriate.
I will provide a bicycle and safety equipment suitable for the Event, keep them in safe operating condition, wear a properly fitted helmet while riding, obey traffic laws, follow reasonable safety instructions, ride within my abilities, and stop riding when continuing would be unsafe.
Ryanne Riegling or a designated Event leader may modify my participation, require me to use a support vehicle, or end my participation when reasonably believed necessary for safety, health, serious misconduct, or the operation of the Event.
If I cannot communicate during an emergency, I authorize Event personnel to contact emergency services, provide reasonable first aid within their abilities, arrange transportation for care, and notify my emergency contact. I remain responsible for expenses associated with medical care or transportation provided to me.
Release of ordinary negligence
To the fullest extent permitted by Michigan law, I release the Released Parties from claims and liabilities for bodily injury, death, property damage, medical expenses, economic loss, and noneconomic loss arising out of or related to my participation in the Event, including claims caused in whole or in part by a Released Party's own ordinary negligence.
This release includes ordinary negligence involving route planning or communication, failure to identify or warn about hazards, ride supervision, group or pace decisions, rest stops, SAG and support operations, bicycle assistance, campsite or meal arrangements, emergency response, support-vehicle operation, and the acts or omissions of Event volunteers.
This release does not apply to gross negligence, willful or wanton misconduct, intentional misconduct, or other conduct that cannot legally be released. It applies only to the Released Parties identified above.
Covenant not to sue and final terms
To the fullest extent permitted by law, I agree not to sue a Released Party for a claim released by this agreement. This agreement is binding on me and my estate, heirs, personal representatives, and assigns to the extent permitted by law.
Michigan law governs this agreement. If any provision is found unenforceable, it will be limited or severed only to the extent necessary, and the remaining provisions will remain effective.
This agreement contains the complete understanding concerning assumption of risk, release of liability, and covenant not to sue for the Event. Electronic signatures and electronically retained records are intended to have the same effect as originals.
I understand that this agreement includes an assumption of risk, a release of claims including claims based on ordinary negligence, and a covenant not to sue. I have read it before signing, had the opportunity to ask questions, and understand that I may choose not to participate.
